Terms of Service
Last updated: July 2026
These Terms of Service ("Terms") govern access to and use of the website watchmerit.com and all related services (the "Platform") operated by WatchMerit Pty Ltd ("WatchMerit", "we", "us"). By accessing or using the Platform, you ("you", "User") agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. What WatchMerit is β and is not
WatchMerit is an independent pricing-intelligence, market-analytics and introduction platform for the luxury watch market. We aggregate publicly available listing information from third-party dealer and marketplace websites and auction results, and we publish estimates, scores, ratings and commentary based on that data.
WatchMerit is not a dealer, broker, auctioneer, escrow agent, financial adviser, investment adviser, credit provider or authenticator of watches. WatchMerit is not a party to, and does not facilitate performance of, any sale, purchase, exchange or trade-in of a watch. We never take custody of a watch, and we never receive, hold or disburse funds in connection with a watch transaction.
Our role is limited to: (a) publishing informational analytics; and (b) where a User pays an unlock fee or submits an enquiry, introducing a buyer and a vendor to one another by exchanging contact details. Once an introduction is made, all negotiation, inspection, contracting, payment, delivery, warranties, returns and dispute resolution occur solely and directly between the buyer and the vendor (or private seller), without further involvement from WatchMerit.
2. Eligibility and accounts
- You must be at least 18 years old and capable of forming a binding contract under Australian law.
- You must provide accurate, current and complete information when registering, submitting an enquiry, or paying an unlock fee, and keep that information up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- We may suspend or refuse to create an account where we reasonably suspect fraud, misuse, or a breach of these Terms.
3. Browsing, enquiries and unlock fees
Listings may be browsed anonymously. To contact a vendor, a User may either submit a free enquiry or pay a one-off unlock fee to reveal the vendor's identity and contact details for a specific listing. By submitting an enquiry or paying an unlock fee, you expressly consent to WatchMerit disclosing your name, contact details and enquiry content to the relevant vendor, and to the vendor's contact details being disclosed to you. This exchange of contact information is an essential and intended function of the Platform.
Unlock fees, once paid, entitle you to the vendor's contact details for that listing only. Unlock fees are non-refundable except as set out in our Refund Policy.
4. No advice β informational content only
All content on the Platform, including the WatchMerit Score, fair-price bands, Buy/Hold/Sell investment ratings, 12-month price outlooks, price history charts, insurance replacement-value estimates, editorial commentary and any AI-generated content (together, "Analytics Content"), is provided for general information purposes only.
Analytics Content does not constitute financial product advice, investment advice, valuation for insurance or lending purposes, legal advice, or a recommendation to buy, sell or hold any watch. Analytics Content is generated from historical and third-party data using proprietary models and may be incomplete, delayed, or inaccurate. You should not rely on Analytics Content as the sole basis for any purchasing, selling or financial decision, and you should obtain independent professional advice and conduct your own inspection and due diligence before transacting. See our Disclaimers page for the full standard disclaimer wording that applies to all Analytics Content.
5. Vendor verification is not authentication
Vendors displaying a "verified" status have supplied business registration and identification information to WatchMerit for account verification purposes only. Verified status does not mean WatchMerit has inspected, authenticated, or guaranteed the condition, provenance, legality of ownership, or genuineness of any watch listed by that vendor. Buyers remain solely responsible for independently verifying authenticity, condition, ownership and any warranty before completing a purchase.
6. Prohibited conduct
- Using the Platform to circumvent an introduction fee, including by contacting a vendor or buyer outside the Platform to avoid an unlock fee where that contact was made possible by a WatchMerit introduction.
- Scraping, harvesting or systematically extracting data from the Platform without our prior written consent.
- Submitting false, misleading or fraudulent listings, enquiries, bids or verification information.
- Reverse engineering, decompiling, or attempting to derive the WatchMerit scoring methodology or underlying models.
- Using the Platform for any unlawful purpose, including money laundering, or in a manner that infringes the rights of any third party.
Breach of this clause may result in suspension or termination of your account and, where a fee was circumvented, WatchMerit may charge the unlock fee that would otherwise have applied.
7. Intellectual property
The WatchMerit name, logo, scoring methodology, databases, software, market analytics, reports and all other platform content (excluding third-party listing data and User-submitted content) are owned by or licensed to WatchMerit and protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent, except for your own personal, non-commercial reference.
8. Third-party listings and content
Listing data displayed on the Platform is collected from publicly available third-party sources. WatchMerit does not warrant the accuracy, completeness or currency of third-party listing data and is not responsible for the conduct, content or offerings of any third-party website or dealer. Any dealer or rights-holder who objects to their listing or images appearing on the Platform may request removal under our Data Collection & Takedown Policy.
9. Limitation of liability and indemnity
To the maximum extent permitted by law, and subject to any consumer guarantees under the Australian Consumer Law that cannot be excluded, restricted or modified ("Non-Excludable Guarantees"):
- WatchMerit provides the Platform on an "as is" and "as available" basis and excludes all conditions and warranties not expressly stated in these Terms;
- WatchMerit is not liable for any loss or damage arising from a transaction between a buyer and a vendor or private seller, including as to the authenticity, condition, legality, delivery or quality of any watch; and
- WatchMerit's aggregate liability for any claim arising out of or in connection with the Platform is limited, at WatchMerit's option, to resupplying the relevant service or refunding the fee paid for that service.
Where a Non-Excludable Guarantee applies and liability cannot lawfully be limited as above, nothing in these Terms limits that liability. You agree to indemnify WatchMerit against any loss, damage, cost or claim arising from your breach of these Terms, your use of the Platform, or any transaction you enter into with another User.
10. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for breach of these Terms or where required by law. You may stop using the Platform at any time. Clauses that by their nature should survive termination (including intellectual property, liability, indemnity and governing law) continue to apply.
11. Changes to these Terms
We may update these Terms from time to time. The updated Terms take effect when posted to the Platform. Continued use of the Platform after an update constitutes acceptance of the revised Terms.
12. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, and each party submits to the non-exclusive jurisdiction of the courts of New South Wales.
